Terms of Use — PixMATON

These Terms of Use (the “Terms”) govern access to and use of PixMATON (the “Platform”). By accessing the Platform, you unconditionally agree to these Terms.

Service purpose

The Platform allows taking photos (selfies and groups), applying custom frames, and sharing the result (e.g., via QR code). The service is provided “as is” for hosting and technical processing purposes.

Account, access, and age

• You represent that you are at least 16 years old or have parental permission.
• You are responsible for the accuracy of the information you provide and for keeping your access links secure.

User content

• You are solely responsible for photos, text, logos, and any other content you upload, create, or share (“Content”).
• You warrant that you have all necessary rights and permissions (copyright, image rights, trademarks).
• You grant PixMATON a non-exclusive, worldwide, royalty-free license strictly limited to technical operation of the service (hosting, processing, transmission) for the duration of hosting.

Prohibited uses

It is prohibited to use the Platform for:

• illegal, defamatory, hateful, violent, pornographic or otherwise harmful content;
• content infringing intellectual property or image rights;
• spam, intrusion, or any action harming security or proper operation of the service.

PixMATON may remove/block Content or access in case of violations.

Retention and deletion

• Photos/Content are stored for 7 days from upload (unless deleted earlier or required otherwise by law).
• After this period, they are irreversibly deleted from PixMATON systems (excluding temporary backups overwritten cyclically).
• PixMATON has no obligation to recover deleted Content.

Personal data

Minimal data required for operation (e.g., confirmation e-mail, session settings) are processed under GDPR on the basis of service performance and legitimate interests (security, abuse prevention). Requests: contact@pixmaton.fr.

Platform intellectual property

All Platform elements (software, trademarks, design, templates not provided by users) are owned by PixMATON or its licensors. Unauthorized reproduction/modification/use is prohibited.

Availability and maintenance

The service may be temporarily unavailable (maintenance, updates, incidents). PixMATON does not guarantee uninterrupted availability or error-free operation.

Disclaimers and limitation of liability

• PixMATON is not responsible for user Content or its use by you or third parties.
• The service is provided “as is”, without express or implied warranty.
• To the extent permitted by law, PixMATON’s total liability for direct damages is limited to amounts you may have paid during the last 12 months; indirect/consequential/non-material damages are excluded.

Third-party services

The Platform may integrate links or third-party services (e.g., WhatsApp). Those are subject to their own terms; PixMATON is not responsible for them.

Security

Reasonable measures are implemented. You are responsible for use of your access links and must promptly report any unauthorized access.

Termination

PixMATON may suspend or terminate access in case of breach of these Terms or risk to security/third parties.

Changes

These Terms may be updated. The applicable version is the one published on this page at the time of access.

Governing law and jurisdiction

These Terms are governed by French law. Disputes shall be submitted to the competent courts in France, subject to mandatory legal provisions.
